Middlesex County District Attorney Marian Ryan, Middlesex County Sheriff Peter Koutoujian and Somerville Police Chief David Fallon have announced that Christopher Carney, 43, of Austin, Texas was arraigned on Tuesday, January 12, 2016, in Woburn Superior Court on charges of aggravated rape, aggravated kidnapping, indecent assault and battery (2 counts), assault and battery with a dangerous weapon and witness intimidation. Clerk Magistrate Michael Sullivan ordered the defendant held without bail pending a 58A dangerousness hearing on January 28, 2016.

The defendant, who was a Somerville resident in 2004, is facing charges stemming from a June 2004 sexual assault in the Davis Square area of Somerville. The defendant’s DNA profile was linked to evidence obtained from the victim in the aftermath of the attack. Middlesex deputy sheriffs returned the defendant to the Commonwealth on Monday January 11.“The arraignment of this defendant is a result of our commitment to pursuing cases and the collaborative effort between our law enforcement partners,” stated District Attorney Ryan. “Because of this commitment, the defendant, who allegedly attacked the victim in this case more than 11 years ago, has been returned to the Commonwealth to face the charges for his alleged crimes.”“Acting in conjunction with our partners in the District Attorney’s Office and Somerville Police Department, our deputies placed the defendant under arrest in Texas earlier this week and ensured his secure transport back to the Commonwealth to answer to these charges,” said Sheriff Koutoujian. “I commend all the investigators and prosecutors involved for their tremendous work in this case.”“I want to thank District Attorney Ryan, Sheriff Koutoujian, Captain Donovan, Sergeant Lavey and Detective Dottin, and all involved law enforcement partners for their dedication to the victim and the pursuit of justice in this case,” said Chief Fallon.In June of 2004, the defendant allegedly followed the victim as she was walking home in Somerville. The defendant then allegedly held a knife to the victim’s throat and ordered her into a parking lot where he handcuffed her to a dumpster. The defendant is accused of sexually assaulting the victim in that parking lot. After the
assault the defendant allegedly threatened the victim and instructed her not to tell anyone and not to tell the police.

These charges are allegations and the defendant is presumed innocent until proven guilty.

The prosecutor assigned to this case is Assistant District Attorney Nicole Allain.
