Police officers were dispatched to a Broadway residence last week in response to a report of an assault.

Upon arrival, the officers spoke with the victim, a woman who told them that an unknown male had attempted and successfully got into her apartment, urinated at the bottom of her stairs and pushed her when she confronted him.

The victim showed the officers a picture had taken of the man with her mobile phone. The officers reportedly recognized the man as someone they had observed walking eastbound on Broadway towards Magoun Square. The officers then advised the victim that they would attempt to track down the man for questioning.

A short time later, the officers spotted the man standing outside of On The Hill Tavern on Broadway and proceeded to question him about the incident.

The man, identified as James Huguley, of Medford, reportedly began shouting as the officers approached him, screaming, “That bitch has my phone!”

When asked by the officers what phone he was referring to, Huguley reportedly replied, “The bitch who called you, she stole it.”

The officers then asked Huguley why he had gone into the house, and he reportedly answered, “To keep warm.”

The officers advised Huguley that entering someone’s house without permission is breaking and entering, to which he reportedly stated, “I didn’t know that.”

Huguley was then asked if he urinated inside the victim’s home and he reportedly stated that if the urine was there that it was not his.

When asked why Huguley pushed the victim and he reportedly told them, “Because she has my phone.”

The officers then advised Huguley that he was going to be placed under arrest for breaking and entering, and he reportedly stated, “It is not breaking and entering if the doors are open.”

Huguley was taken into custody and charged with threat to commit a crime, felony nighttime breaking and entering, and assault and battery.

During a follow-up interview with the victim, she reportedly told the officers that she heard her door open and when she looked down her stairs, she saw Huguley urinating on her stairs.

She told the officers that she screamed at him to leave and he left the apartment. She then stated that he started banging on the door saying he wanted his phone back. She opened the door and he pushed her, according to her testimony. She also told officers that as she stepped back, her dog came to her defense, scaring off Mr. Huguley, at which time she was able to shut the door.

According to the victim, Huguley continued to bang on the door, stating he was going to kill her and he would be back to kill her dog, after which he left.

The officers asked the victim if the door was locked and she reportedly stated that it locks automatically and was locked at the time of the occurrence. She said she believes he was banging so hard that it forced the door to open. She also said she was scared for her and her dog’s safety.
